By agreeing to these Terms of Service, you confirm you are of legal age and allow minors to use the Services on your devices. You must provide accurate and complete information, including email, billing, payment, and shipping details. Maintain account security and avoid sharing your credentials.

Online product representations may vary in colors. Appearance and quality may differ from depiction. Descriptions subject to change, quantities may be limited.

Orders are offers to purchase; we may accept or decline. Payment required before acceptance. Review orders as cancellations may be limited. Returns/exchanges follow our Refund Policy.

Prices, discounts, and promotions may change without notice. Final price in order email may not include extra charges. Online store prices may vary from physical or third-party stores. Promotions governed by separate terms.

Section 5 - Shipping + Delivery
We are not liable for shipping delays or delivery times. Once products are transferred to the carrier, title and risk pass to you.

Medium Small’s names, logos, product and service names, designs, and slogans are trademarks of Medium Small or its affiliates or licensors. You must not use such trademarks without the prior written permission of Medium Small. Shopify's trademarks are Shopify, while other trademarks belong to their respective owners.

Access to third-party customer tools is at your own risk and discretion. Familiarize yourself with and accept terms from third-party providers. Future services will be subject to these Terms of Service.

Section 8 - Third Party Links
The Services may contain materials and hyperlinks provided by third parties. We are not liable for harm or damages related to third-party websites. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third-party.

Section 9 - Relationship with Shopify
Medium Small is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Medium Small. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Medium Small, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Medium Small.

Section 10 - Privacy Policy
Information collected through the Services is subject to our Privacy Policy and Shopify’s Privacy Policy. By using the Services, you acknowledge these policies. Refer to our Privacy Policy for more details.

By submitting content or feedback, you grant us a perpetual, royalty-free license to use it for any purpose. Compliance with Terms and accountability for accuracy are required.

Section 12 - Errors, Inaccuracies + Omissions
Occasionally there may be errors in product information, pricing, and availability. We reserve the right to correct these errors without notice.

Utilize Services only for lawful purposes to avoid suspension or termination of account for unlawful, malicious, infringing, harassing, or misleading activities.

We reserve the right to terminate this agreement without notice. You are responsible for all due amounts up to termination. Specific sections will persist post-termination.

General information only. No warranty on accuracy or completeness. Products offered 'as is'.

Section 16 - Limitation of Liability
Medium Small is not liable for any damages resulting from use of services or products, including lost profits, lost data, or replacement costs. 

Section 17 - Indemnification
You must indemnify, defend, and hold harmless us and our affiliates from losses or claims due to your actions. Notify us of any claims, we will handle defense and settlement at your cost. We will not settle non-monetary claims without your consent.

Section 18 - Severability
If any part of these Terms of Service is found unlawful or unenforceable, it will not affect the validity of the other provisions. 

Section 19 - Waiver; Entire Agreement
Failure to exercise rights in Terms of Service does not constitute a waiver. Terms govern use and supersede prior agreements. Ambiguities do not favor the drafting party.

You cannot transfer or assign this Agreement or your rights without our consent; we can do so without notice or consent. 

Section 21 - Governing Law
Terms of Service and agreements are governed by federal and state courts where Medium Small is headquartered. Both parties consent to venue and personal jurisdiction.

The headings in this agreement are for convenience only and do not limit these Terms.

Review the latest Terms of Service on this page. We may update or change them at any time. Your continued use of Services after changes means acceptance.
